Terms of Use & Privacy Policy

Welcome to the Bombshell Bake Shoppe website. ("company', "we", "us" or "our"). The following Terms and Conditions, together with Our Privacy Policy (collectively, these "Terms of Use"), govern your access to and use the bombshellbakeshoppe.com website, including any content, funtionality and services offered on or through bombshellbakeshoppe.com ("the website"), whether as a guest or registered user. Please read the Terms of Use carefully before you start to use the website. By using the Website, you accept and agree to be bound and abide by these Terms of Use and Our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the Website.

This Website is offered and available to users who are 18 years of age or older and reside in the United States or any of its territories or possessions. By using this Website, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

Late Fee

A LATE FEE of $25 will apply to orders not picked up within 10 (ten) minutes of scheduled pick up time. Failure to pick up your order by scheduled pickup time may result in the rescheduling or cancellation of your order. NO REFUNDS will be given for abandoned orders.

Minimum Purchase Requirement Policy

There is a minimum purchase requirement of $100 to place an order.

Payment Policy

The following payment methods are excepted: Zelle, CashApp and *PayPal (*restrictions apply).

A minimum retainer of 50% is due to reserve your date. Payment in full is due 2 (two) weeks prior to delivery. Orders will not be processed until payment in full has been received. In the event of last minute orders or those under $150, payment in full is due upon order confirmation. A $25 Rush Fee is applicable for custom orders placed within 2 (two) weeks of due date. At no time will we accept cash on delivery.

Refund Policy

All orders are Non-Refundable and Non-Transferable unless otherwise stated. *ALL SALES ARE FINAL.

Chargeback Policy

At Bombshell Bake Shoppe, we do not tolerate credit card fraud. No expense will be spared and all fraud without exception will be prosecuted to the full extent of the law. In addition, we will pursue civil legal action seeking any loss of income related to the fraud, including businesss, legal fees, research costs, employee down time and loss of revenues.

Bombshell Bake Shoppe also considers credit card chargebacks and PayPal disputes to be fraud if you made no reasonable effort to notify us that a problem existed and allow us considerable time to resolve or clarify the matter. In addition, Bombshell Bake Shoppe considers credit card chargebacks and/or PayPal disputes made after receiving goods and/or services to be fraudulent.

Frivolous chargebacks not only cost our employees time away from their usual and customary manners of conducting normal business, but costs us money, therefore:

YOU AGREE that if you choose to do business with Bombshell Bake Shoppe and file a dispute/claim or chargeback with your credit card company for a situation that contradicts our terms and conditions which you agree to when placing your order OR have not allottedd us sufficient time to acknowledge, confirm and research the situation; and as of any result, you do not when the chargeback arguement or dispute/claim YOU AGREE to pay us $ 150.00 for our time responding to the matter. YOU AUTHORIZE us to charge this amount to your credit card. If this charge is rejected, Bombshell Bake Shoppe will persue legal action to recoup losses for our time associated with responding to the chargeback and/or dispute/claim in addition to any other fees, explained below.

In the event that you win the chargeback with your credit card company, Bombshell Bake Shoppe will attempt to recover fraudulently disputed charges plus additional costs via a third-party collection agency and your account will be reported to all credit bureaus as a deliquent collection account. This may severely damage your credit rating for at least the next seven (7) years.

Cease and Desist

Client understands and is hereby notified that once a chargeback, dispute/claim or legal action is taken; all communication where it be via email, telephone, internet, social media, U.S. mail with Bombshell Bake Shoppe will cease and desist.

Right to refuse a client

As a side note, Bombshell Bake Shoppe reserves the right to cancel an order and/or issue a refund, and pursue legal action against any customer who is deemed hostile. Hostile customers are those who initiate chargebacks or disputes/claims without valid cause (particularly after the receipt of goods and/or services), who threaten or harass staff members in person, over the phone, via email, social media and those who attempt to slander and/or commits acts of libel against Bombshell Bake Shoppe and all divisions hereunder.

We are not interested in legal battles but are prepared to take them on when necessary.

LEGAL: You agree via your conducting business with Bombshell Bake Shoppe that any legal action resulting from any transaction will be guided by the laws of and take place in Bombshell Bake Shoppe's home state of Georgia. You agree to reimburse us or any representative we may appoint for any legal expenses your actions may make us incur. We take fraud seriously. If any provision of this agreement is deemed illegal, invalid or unenforceable, the remaining revisions shall remain in full force and effect. The waiver of a breach hereunder does not waive any other or subsequent breach.

Please note our policy on chargeback

Customer understands that Company does not tolerate fraudulent chargebacks or frivolous disputes/claims and will proceed to collect by any means necessary
Customer is responsible for chargeback fees consisting of attorney's fees, fees for collection agencies or third party intervention if client fraudulently charges back or does not pay monies owed
If customer charges back fraudulently, client will owe chargeback fees plus additional monies owed
Company will report any outstanding balances to the three major credit bureaus (Equifax, Experion, Trans Union) as a deliquent collection account
Company will have the incident reported to anti-fraud databases, which will attempt to prevent any further purchases on the internet

Stolen Credit Card Purchases

We log IP streams on all orders - any orders coming back as a chargeback due to fraudulent activities will be diligently pursued through your local jurisdiction for prosecution to the fullest extent of the law.

Email Policy

We (Bombshell Bake Shoppe) now have a three (3) email policy per customer inquiry. Phone consultations are available at $25 per half hour. If/when you decide to book us for your event, the consultation fee will be applied to the final balance of your order.
